Overview

This website is operated by Aerocutt Pty Ltd. Throughout these Terms, “Aerocutt”, “we”, “us” and “our” refer to Aerocutt Pty Ltd.

By accessing or using this website, placing an order, or purchasing a product from Aerocutt, you agree to be bound by these Terms of Service, together with our Shipping Policy, Return & Refund Policy and Privacy Policy.

Our goods come with guarantees that cannot be excluded under Australian Consumer Law.

Product Information

Aerocutt makes reasonable efforts to ensure that product descriptions, specifications, photographs, fitment information, pricing and other information displayed on this website are accurate.

Due to ongoing product development and manufacturing improvements, product specifications may change without notice, provided that any changes do not materially reduce the product’s function, compatibility or quality compared with the product ordered.

If a proposed change would materially affect a product’s function, compatibility, appearance or intended use, Aerocutt may contact the customer before fulfilling the order.

Product photographs are provided for illustrative purposes. Minor differences may occur between photographs and the product supplied, including differences in colour, finish, hardware, branding, manufacturing marks or other non-functional details.

Manufacturing Variations

Aerocutt products may be manufactured using processes including laser cutting, folding, welding, machining and powder coating.

Minor manufacturing variations may occur between products, including variations in dimensions, surface finish, colour, texture, fold marks, tooling marks, weld appearance and powder coating.

These minor variations are not considered defects where they are reasonably consistent with the manufacturing process and do not materially affect the product’s function, fitment, durability or overall quality.

Vehicle Compatibility

Customers are responsible for reading the complete product description and carefully reviewing all photographs, specifications, vehicle details and fitment information before ordering.

Customers must confirm that their vehicle’s make, model, year, chassis, body style, engine, transmission and any other relevant details match the compatibility information stated in the product listing.

Fitment may be affected by previous vehicle modifications, accident repairs, non-standard components, aftermarket equipment, manufacturing variations or differences between vehicle markets and model variants.

If you are unsure whether a product is suitable for your vehicle, you should contact Aerocutt before purchasing.

Nothing in this section limits Aerocutt’s responsibility for ensuring that a product matches its description or for specific fitment advice provided by Aerocutt on which a customer reasonably relies.

Order Confirmation

By placing an order with Aerocutt, the customer confirms that they have:

  • Read the complete product description

  • Reviewed the product photographs, specifications and fitment information

  • Confirmed that the selected product is suitable for their vehicle

  • Checked all selected options, quantities, delivery details and payment information

  • Read and agreed to Aerocutt’s Shipping Policy and Return & Refund Policy

Customers are responsible for contacting Aerocutt before ordering if they are uncertain about product compatibility, fitment, specifications or any other information contained in the product listing.

Placing an order accidentally, selecting an incorrect product, vehicle, option or quantity, or no longer wanting the product is considered a change of mind where the customer completed checkout and the information supplied by Aerocutt was accurate.

Aerocutt begins processing and fulfilling orders immediately after they are placed. As a result, change-of-mind cancellation requests cannot be guaranteed, including where an order has not yet been dispatched.

Nothing in this section limits Aerocutt’s responsibility for inaccurate or misleading product information or any rights or remedies that cannot lawfully be excluded.

Orders and Acceptance

Placing an order constitutes an offer to purchase the selected products in accordance with these Terms.

An automated order confirmation acknowledges that Aerocutt has received the order but does not necessarily confirm that the order has been accepted for fulfilment.

Aerocutt may decline or cancel an order before dispatch where:

  • A product is unavailable

  • There has been a genuine and obvious pricing, description or listing error

  • The order has been identified as potentially fraudulent or unauthorised

  • The customer has provided incomplete or incorrect order information

  • Aerocutt cannot reasonably fulfil the order

  • The order would breach any applicable law or restriction

If Aerocutt cancels an order after payment has been received, the amount paid for the cancelled product will be refunded using the original payment method, subject to any rights or obligations imposed by law.

Pricing and Payment

Prices are displayed in the currency shown on the website and include or exclude applicable taxes as stated at checkout.

Customers are responsible for reviewing the total product price, shipping cost, applicable taxes and order details before completing payment.

Payment must be successfully authorised and received before an order is fulfilled.

If an obvious pricing or listing error is identified after an order is placed, Aerocutt may contact the customer to confirm whether they wish to proceed at the correct price or cancel the affected item and provide a refund.

Product Availability and Lead Times

Some products may be held in stock and available for prompt dispatch.

Other products may be manufactured, laser cut, folded, welded, powder coated, assembled or sourced specifically to fulfil an order. Processing and manufacturing times may therefore vary.

Where a product is supplied with a powder coated finish, powder coating may be completed specifically after the customer’s order is placed. Powder coating may require up to approximately 10 business days before the product is ready for dispatch. This timeframe is in addition to any applicable manufacturing, laser cutting, folding, welding, assembly or other processing time required to produce the product.

Accordingly, a powder coated product that is not already held in finished stock may require both a manufacturing lead time and a subsequent powder coating lead time before dispatch.

Any processing, manufacturing, powder coating or dispatch timeframe provided by Aerocutt is an estimate unless expressly stated otherwise. Actual timeframes may vary depending on production scheduling, powder coating availability, order volumes, material availability and other circumstances reasonably affecting production.

For other custom jobs including engraving, etching or and work done which isn’t listed on the website, our lead time can vary, typically from 7-21 days depending on the work completed. If an accurate ETA is required, please contact us via email to avoid disappointment.

Order Changes and Cancellations

Order fulfilment may begin automatically or shortly after an order is placed. This may include ordering or allocating materials, laser cutting, folding, welding, preparing the product for finishing, sending the product for powder coating, assembly, packing or other production and fulfilment activities.

Where a powder coated finish has been selected, the product may be manufactured and/or sent for powder coating specifically to fulfil the customer’s order.

Requests to change or cancel an order should be submitted as soon as possible. Aerocutt cannot guarantee that an order can be changed or cancelled after fulfilment or manufacturing has commenced, including where a product has been manufactured, sent for powder coating, powder coated, assembled, packed or otherwise prepared for the customer’s order.

Change-of-mind, accidental-order and cancellation requests are handled in accordance with our Return & Refund Policy and do not limit any rights that cannot be excluded under applicable law.

Installation

Aerocutt products are intended for installation on motor vehicles by persons with suitable mechanical knowledge, tools and experience.

Where installation instructions are supplied, they should be read and followed. Customers are responsible for ensuring that all fasteners, mounting points, clearances and surrounding vehicle components are checked during installation.

Where installation instructions are not supplied, the customer is responsible for ensuring that the product is installed safely and correctly using appropriate methods.

If you are not confident installing a product yourself, Aerocutt recommends having it installed by a qualified mechanic, fabricator or automotive professional.

Aerocutt is not responsible for loss or damage caused by incorrect installation, the use of unsuitable tools or fasteners, failure to follow supplied instructions, failure to check clearances, or installation by a person without suitable knowledge or experience.

Nothing in this section excludes Aerocutt’s responsibility for a defective product, incorrect product description, incorrectly supplied component or defective installation instruction.

Product Modification and Misuse

Unless the product description states otherwise, Aerocutt products should not be cut, drilled, bent, welded, reshaped or otherwise modified.

Aerocutt is not responsible for loss, damage or fitment issues caused by:

  • Incorrect installation

  • Unauthorised modification

  • Misuse or use outside the product’s intended purpose

  • Impact, collision or accident damage

  • Failure to inspect or maintain the product

  • Loose, missing or incorrectly fitted fasteners

  • Installation with incompatible vehicle components

  • Changes made to the vehicle after the product was installed

Modification of a product may affect eligibility for a change-of-mind return. This does not limit a customer’s rights where a modification was reasonably necessary because of a product failure, incorrect instructions or another matter for which Aerocutt is legally responsible.

Aftermarket Products and Vehicle Modifications

Aerocutt products are aftermarket components intended for vehicle modification, customisation and/or motorsport applications.

Unless expressly stated otherwise, Aerocutt does not represent or warrant that a product, its installation or its use complies with every roadworthiness requirement, vehicle standard, registration requirement or other law applicable in the customer’s jurisdiction.

The purchaser is responsible for determining whether a product and its intended installation and use are legal and appropriate for their vehicle and location. This includes determining whether any inspection, modification plate, certification, engineering approval or other authorisation is required.

The purchaser is also responsible for ensuring that the installation and use of an Aerocutt product does not make the vehicle unsafe or non-compliant with applicable laws or vehicle standards.

Products used in motorsport, competition, off-road or other non-standard applications are used at the purchaser’s own risk, subject to any rights that cannot be excluded under applicable law.

Where Aerocutt expressly describes a product as suitable for a particular vehicle, application or use, the product will remain subject to any consumer guarantees and other rights that apply to that description.

Shipping and Delivery

Shipping costs are calculated or displayed at checkout based on the destination, package size and shipping method selected.

Customers are responsible for providing complete and accurate shipping and contact information. Aerocutt is not responsible for additional costs or delays caused by incorrect or incomplete information supplied by the customer, except to the extent caused or contributed to by Aerocutt.

Delivery timeframes are estimates and may be affected by carrier delays, customs processing, weather, peak periods, regional service interruptions and other circumstances outside Aerocutt’s reasonable control.

Returns and Refunds

Returns, refunds, exchanges, order cancellations and change-of-mind requests are handled in accordance with our Return & Refund Policy.

Customers should inspect products after delivery and contact Aerocutt as soon as reasonably possible if an item is incorrect, damaged or believed to be defective.

Nothing in these Terms or our Return & Refund Policy excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded, restricted or modified.

Limitation of Liability

To the maximum extent permitted by law, Aerocutt is not liable for loss, damage, injury or expense caused by:

  • Incorrect or unsafe installation

  • Unauthorised product modification

  • Misuse, neglect or abnormal use

  • Impact, collision or motorsport damage

  • Failure to inspect, maintain or secure the product

  • Installation with incompatible or modified vehicle components

  • Continued use of a product after damage, loosening or another issue becomes apparent

  • A failure to comply with supplied instructions or applicable vehicle requirements

This exclusion applies except to the extent that the loss, damage, injury or expense was caused or contributed to by Aerocutt or arose from a right or guarantee that cannot lawfully be excluded.

To the maximum extent permitted by law, Aerocutt is not liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable, except where such liability cannot lawfully be excluded.

Nothing in these Terms excludes, restricts or modifies any rights, guarantees, remedies or other protections that cannot lawfully be excluded, restricted or modified, including those available under Australian Consumer Law.

Intellectual Property

All intellectual property rights owned by Aerocutt in its website content, branding, trade marks, product photographs, graphics, written content, technical drawings, CAD files, digital models, manufacturing information and original product materials remain the property of Aerocutt Pty Ltd.

To the extent that intellectual property rights subsist in Aerocutt’s product designs and associated materials, those rights also remain the property of Aerocutt Pty Ltd.

Aerocutt content and materials must not be copied, reproduced, modified, republished, distributed, commercially exploited, reverse engineered or used to manufacture or develop competing products without Aerocutt’s prior written consent, except where permitted by law.

Purchasing an Aerocutt product does not transfer ownership of Aerocutt’s intellectual property or grant the purchaser a licence to reproduce, manufacture or commercially exploit the product or its design.

Third-Party Services

This website may use or link to third-party services, including payment providers, shipping providers, social media platforms and external websites.

Aerocutt is not responsible for the content, availability, security or practices of third-party websites or services that it does not control.

The use of third-party payment or delivery services may also be subject to the third party’s own terms and policies.

Changes to These Terms

Aerocutt may update these Terms from time to time to reflect changes to its products, business practices or legal obligations.

Updated Terms will take effect when published on this website or from any later date stated in the updated Terms.

Changes will not retrospectively alter the terms applying to an order that Aerocutt accepted before the updated Terms took effect, unless required by law or agreed with the customer.

Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.

Governing Law

These Terms are governed by the laws of Victoria, Australia.

The parties submit to the non-exclusive jurisdiction of the courts of Victoria and any courts entitled to hear appeals from those courts.

Nothing in this section limits any rights a customer may have under mandatory laws applicable in their jurisdiction.
